Appeal from and supersedeas to a decree of the circuit court of the county of Wood, rendered on the 9th day of April, 1878, in a cause in said court then pending, wherein Benjamin S. Compton was plaintiff, and J. C. Gilman, William Burk and C. Coville were defendants, allowed upon the petition of said Compton. Hon. J. M. Jackson, judge of the fifth judicial circuit, rendered the decree appealed from.

B. S. Compton brought a suit in equity with foreign attachment against C. Coville to recover the amount of a certain draft held by him and accepted by Coville. Coville answered alleging payment of the draft and claiming, that Compton was indebted to him by reason of a check for $1,000.00 on the Toledo Savings Bank of Ohio, and praying for affirmative relief under section 35, chapter 125 of the Code of 1868.
