This suit was begun in the circuit court of Jackson county, by the plaintiff, to recover the sum'of $25,000 damages for personal injuries sustained by him through the alleged negligence of the defendants.
A trial was had, and at the close of plaintiff’s evidence the court, at the request of defendants, gave a peremptory instruction directing the jury to find for the defendants. In obedience to that instruction the jury returned a verdict for them.
