— This is an action by appellee against appellant William P. Carmichael, to collect his alleged pro rata share of the expense of repairing a certain levee along the Wabash river, and to declare and enforce a lien against his real estate for the amount due.
The suit was begun in the Fountain Circuit Court, and appellant filed a plea in abatement, showing that he and his codefendants were all legal residents of Warren county, Indiana, and that the cause of action was not connected with any business or transaction, or any office or agency of any of the defendants in said Fountain county, and that…
