FINDINGS OF FACT AND CONCLUSION OF LAW

Introduction
A motion was filed by the United States Trustee for the Southern District of New York on notice to the debtor and all creditors to dismiss the Chapter 11 case of Fitzgerald Group (hereinafter the “debtor”) pursuant to 11 U.S.C. § 305. A hearing was held on July 11, 1983 at which time only the United States Trustee and Jeffrey M. Fitzgerald, the sole surviving partner, appeared.
