1Opinion of the Court

MORTON, District Judge.

This is a case of composition after adjudication. The bankrupts made an offer of 25 per cent, which was accepted by the creditors, but was objected to by a substantial number and amount of them. The referee reported that the offer was inadequate, because, in his opinion, the estate would pay upon full administration 33 or 34 per cent. This report was confirmed, and the composition was disapproved by the court. The bankrupt appealed from that decision. Subsequently the appeal was withdrawn, and a new offer in composition of 33 per cent, was made by the bankrupt, which…
