Appeal from El Paso County Court; Albert S. Eylar, Judge. Action by J. I. Broyles against H. W. Goldman and others. Judgment for plaintiff, and defendant Goldman appeals.

1Opinion of the Court

Appellee, J. I. Broyles, instituted this suit in the county court of El Paso county against appellant, H. W. Goldman, to collect rents alleged to be due by virtue of a written contract of lease for a certain store building. Before filing the suit appellee sued out a distress warrant, and caused it to be levied upon property belonging to the appellant, which the appellant replevied, making his replevy bond with B. Blumenthal and E. C. Pugh as sureties thereon.
