This action was brought by the city of Fergus Falls to recover-from defendant, Otter Tail county, certain moneys collected by the county treasurer as interest and penalties on taxes and assessments levied by the city on city property, and also certain sums received by the county treasurer from county depositaries as. *347interest on deposits of the money so collected by him. Plaintiff had judgment in the court below, and defendant appealed from an order denying its motion for a new trial.
