STEWART, Circuit Judge:

Charlie Livingston (“Livingston”), a Texas death-row inmate, appeals the district court’s dismissal of his petition for a writ of habeas corpus under 28 U.S.C. § 2254 and requests a certificate of probable cause (“CPC”) from this Court to appeal the district court’s decision. We treat Livingston’s request for CPC as a request for Certificate of Appeala-bility (“COA”).
