This is a suit for 25 per cent of the profits of Chomeau Engelland, Inc. for the year 1945 which amount is claimed to be due plaintiff by reason of an oral contract entered into on December 23, 1944. The jury found for plaintiff in the sum of $3500.

The defendant corporation was engaged in a real estate business which consisted of acting as broker for the sale of real estate, making property appraisals, developing subdivisions, building houses, and selling a general line of insurance.
