WOLFE, Commissioner.
This is an action by which the plaintiffs sought to recover damages arising out of the destruction of their furniture and personal property by fire, while stored in a warehouse of the defendant. Four counts were pleaded as grounds for recovery. The court sustained defendant’s motion for a judgment on counts 3 and 4 and the plaintiffs dismissed as to count 2. The case was submitted on the remaining count 1, and a verdict was returned for plaintiffs.
