PHILIPS, District Judge.
The plaintiff, a porter in the employ of the Pullman Palace Car Company, a corporation engaged in running sleeping cars over the defendant railroad pursuant to a contract between it and the defendant, sues the defendant company for damages resulting from personal injuries received while in the line of his duty as a porter in one of the sleeping cars of the Pullman Company in the state of California by reason of the alleged negligence of the defendant company in running one of its freight trains onto a siding so as to run into said sleeping car.
