This cause is before the Court upon defendants’ motion for a summary judgment in their favor pursuant to Rule 56 of the Federal Rules of Civil Procedure, 28 U.S.C.A.

Plaintiff and defendants have entered into a stipulation of facts for the purposes of this motion. According to that stipulation, defendants own and operate the Twin Star Rocket as a joint train between Minneapolis, Minnesota, and Houston, Texas.
