Plaintiffs Richard L. Walkup and Jean G. Walkup here present a novel legal theory for recovery against the bank and''mortgage sub-servicer that denied their repeated applications for a mortgage loan modification under the federal Home Affordable Modification Program (“HAMP”). They do not claim that they were improperly denied a modification. Rather, they allege that Defendants Santander Bank, N.A.
