WHITMAN KNAPP, District Judge.

Plaintiff Scott Pastre has brought the instant action under 42 U.S.C. § 1983 and under the Fourth, Fifth and Fourteenth Amendments to the United States Constitution against two New York State Troopers, Thomas L. Weber and Robert E. Pineau (“defendants”), on claims of “unlawful arrest” and “excessive use of force”. He also alleges pendent state claims of assault and battery, infliction of emotional distress, negligence and gross negligence.
