Action arising out of the delivery of certain promissory notes by the defendant to the plaintiff, under a written memorandum, in December, 1919. All three banks involved were organized under the banking laws of this state and, as such, were engaged in the general banking business in Big Stone county. The appellant, First State Bank of Correll, is the successor to the Farmers & Merchants State Bank, and subject to all the liabilities thereof.
