HALE, Justice.

Walter Grammer filed this suit in the court below on July 2, 1951 against the City National Bank of Cleburne, hereafter referred to as the Bank, seeking recovery of $38,532.05 with interest thereon at the rate of 8% per annum from certain dates in 1946. As grounds of the recovery sought, he alleged in substance, among other things, that he was engaged in the business of buying cotton at Cleburne for many years prior to April 1, 1946 and in the conduct of his business he carried a checking account with the Bank under the name of “Walter Gram-mer Cotton Account”; that W.
