OPINION
FABER, District Judge.
This Opinion replaces the court’s original Opinion filed in this ease on March 31, 1997. By Judgment Order entered on that date, this court denied the application of petitioner Ronald Gene Daniel (“Daniel”) for a writ of habeas corpus pursuant to 28 U.S.C. § 2254.
