Miguel Paredes is scheduled to be executed on Tuesday, October 28, 2014. On Saturday, October 18, 2014, ten days before his scheduled execution, he filed in the federal district court a “Motion for Relief from Judgment Pursuant to Rule 60 of the Federal Rules of Civil Procedure and Stay of Execution.” The federal district court dismissed the Rule 60(b) motion without prejudice for want of jurisdiction and transferred the motion to this court, citing 28 U.S.C. § 1631.
