This appeal is prosecuted by plaintiff from a judgment of dismissal predicated upon an order sustaining a demurrer to the complaint without leave to amend. Upon the occasion of entering the minute order sustaining the demurrer without leave to amend, the court directed that the signing and filing of a formal judgment be withheld for a period of ten days to afford plaintiff an opportunity to make application to file an amended complaint.
