Currently before the Court is plaintiffs motion to compel discovery and for sanctions pursuant to Rules of the Court of Federal Claims (“RCFC”) 37(a)(5). In its 1 motion, the plaintiff in this case, Confidential Informant 59-05071, challenges the assertion of the attorney-client privilege by the United States (“the government” or “defendant”) in response to plaintiffs requests for production of certain documents.
