HARTEN, Judge.*

The purchase agreement for a real property sale gave appellant, the seller, a mort*216gage lien on the home of respondents, the purchasers, who then obtained another home mortgage from respondent bank. After closing, appellant cancelled the purchase agreement and brought this action against the purchasers to enforce appellant’s mortgage lien and to obtain a money judgment for alleged breach of contract, misrepresentation, fraud, and civil conspiracy, and against respondent bank for a declaration that appellant’s mortgage had priority over the bank’s mortgage.
