*771Appeal from an order of the Steuben County Court (Joseph W. Latham, J.), entered April 14, 2003. The order, insofar as appealed from, granted defendant’s motion in part and reduced count one of the indictment from manslaughter in the second degree to criminally negligent homicide and dismissed count two of the indictment, charging defendant with reckless endangerment in the first degree.

It is hereby ordered that the order insofar as appealed from be and the same hereby is reversed on the law, the motion is denied in its entirety, counts one and two of the indictment are reinstated, and the…
