This was a suit by Morey and Godman against Noakes, Graves, and Snyder, to recover damages for a breach of contract. The complaint was in two paragraphs, founded on separate contracts. On the first the appellees recovered a judgment, but the appellants, the de*104fendants below, had judgment on the second, and hence no question is presented by them on that paragraph.
