Rose, Judge:

In this case we have for determination ultimately the question of the legality of a series of general obligation bonds in the amount of $40,000.00, and a series of so-called revenue bonds in the amount of $160,000.00, authorized by the City of Grafton by separate ordinances adopted on June 22, 1942, and the 14th day of January, 1943, respectively.

The Charter of the City of Grafton is Chapter 79 of the Acts of the Legislature of 1913, by Section 19 of which the city is empowered “to acquire, hold, maintain, control, or dispose of a hospital or a public library, or any property for…
