This case arises out of an interlocutory appeal under Article 62, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 862 (2012), in a pending court-martial.
At trial, the military judge struck the complaining witness’s testimony, citing as the basis for her ruling the Government’s failure to provide the defense with a recording of the complaining witness’s Article 32, UCMJ, 10 U.S.C. § 832 (2012), testimony as required under the Jencks Act, 18 U.S.C. § 3500 (2012), and Rule for Courts-Martial (R.C.M.) 914.
