In an action on a promissory note, the trial court instructed a verdict for the defendant. Plaintiff appeals.

Plaintiff bank in its amended petition alleges that the defendant on October 5, 1928, gave his note for $2,500 to the State Bank of Minatare; that said note bore 10 per cent, interest from date, and its maturity was December 5, 1928; that on October 6, 1928, the State Bank of Mina*269tare, in due course of business and for a valuable consideration, assigned and delivered the note to the plaintiff, who has ever since been the owner and holder thereof.
