Metropolitan Sewer District (“MSD”) appeals a jury verdict assessing 75 percent fault to MSD on AmerenUE’s claim for contribution under section 319.085, RSMo 2000, a part of the Overhead Power Line Safety Act (“the OPLSA”). 1 On appeal, MSD claims that the trial court erred in overruling MSD’s motion for judgment notwithstanding the verdict because MSD does not fall within the definition of “persons” to whom the OPLSA applies.
