HARVEY, Presiding Judge.
The controversy in this suit arises from the conflicting claims asserted by the First National Bank of Breckenridge and the Bridgeport Machine Company, respectively, to an unpaid balance due by the Godley Oil & Gas Company for the drilling of an oil well by B. C. Lacey under a drilling contract between the latter and the Godley Company, The sum in controversy was deposited in the registry of the trial court by the Godley Company, and, on tidal of the case, the trial court upheld the claim of the bank to the fund, and rendered judgment accordingly.
