Ward, J.:

The defendants George Moyer and Jacob Moyer, on the 11th day of January, 1892, were the owners dn fee of about sixty-five acres of land in the town of Schroeppel, Oswego county, George Moyer owning five-sixths interest therein and Jacob Moyer one-sixth interest, being the remainder. On the date aforesaid the plaintiff obtained a judgment against the defendants for $630.32, and on the 18th of January, 1892, an execution was issued to the sheriff of 'Oswego county against the' defendant George Moyer, which it ¡appears was returned by the sheriff wholly unsatisfied.
