MARTIN, Judge.

This is the Court’s decision on various defendants’ motions to dismiss on justicia-bility grounds. For the reasons set forth below these motions are denied.

This is a declaratory judgment action brought to determine the rights and obligations of North American Philips Corporation (“Philips”) and 31 insurers alleged to have provided primary and excess liability coverage to Philips over a 36 year period.
