Watson, C. J.:

The appellant, Alfred Anderson, was indicted by the grand jury of Multnomah county, on the 18th of December, 1882, for the crime of murder in the first degree, for the felonious killing of his- brother, Carl Anderson, on Swan island, in said county, on the 9th of the preceding October. At the next January term of the circuit court of said county, he was tried upon said indictment, convicted, and sentenced to death. From this judgment he has appealed.
