On July 30, 2014, Neftali Rivera Nieves (“Rivera” or “plaintiff’) filed a complaint against John M. McHugh, Secretary of the Army (“Secretary” or “defendant”) seeking to correct his military records [D.E. I].1 On November 6, 2014, Rivera filed an amended complaint [D.E. 14], The amended complaint alleges that defendant *671violated numerous military regulations, section 504 of the Rehabilitation Act, see 29 U.S.C. § 794, the Administrative Procedure Act (“APA”), see 5 U.S.C. § 706, and the Fifth Amendment.
