An action for damages, based on alleged negligence, resulted in a verdict and judgment in favor of the plaintiff. The defendant has appealed. The accident occurred on a street crossing, where the plaintiff sought to cross the defendant’s track, and his wagon was immediately struck by defendant’s car. That the plaintiff turned suddenly upon the track, without attempting to ascertain whether a car was near, is clearly proved.
