The matter involved in this appeal was before this Court at a former term, and constitutes the second cause of action, reported in 143 N. 0.,. p. 134. That opinion is referred to for a general statement of the case. The jury having found the issue of contributory negligence against the defendant, and there being no error committed by the court upon the trial of that issue pointed out to ns, that question may be considered settled.
