PREWITT, Presiding Judge.
At issue is the validity of the “license fee for engaging in an occupation” assessed by the City of Springfield. See Springfield, Mo., Code ch. 20, art. I (1986). The trial court, sitting without a jury, found the fee to be valid and plaintiff, a “service station” operator, appeals.
Plaintiff originally appealed to the Missouri Supreme Court which transferred the case, of its own motion, to this district “in which jurisdiction is vested.” The constitutionality or validity of a city ordinance is not within the appellate jurisdiction of the Missouri Supreme Court but…
