This is an action upon a statutory-

bond, brought in the District Court of Ford County, Kansas, by Ripley & Bronson, as plaintiffs, against Douglass Mitchell and others as defendants, to recover the sum of $280.72 and interest.

The petition alleges that Douglass Mitchell,"W. G. Sherlock and JamesLangton were partners, doing business under the firm name of Douglass Mitchell & Co. ; that as such firm they entered into a contract with the officers of the city of Kinsley, to erect and com struct a system of waterworks for said city, consisting among other things, of what is known as a standpipe,…
