BARNEY, Judge.
Appellant, State of Missouri (“State”), appeals the judgment of the Circuit Court of Greene County which sua sponte dismissed, with prejudice, an information charging Respondent Paul E. Stringer (“Respondent”) with misdemean- or stealing. § 570.030.1, RSMo 1994.1 In the court below, Respondent appeared pro se as he does now in this appeal. The record is devoid of a showing that the circuit court either heard or received evidence prior to entering its judgment of dismissal with prejudice.
