In her complaint in this action the plaintiff set forth a cause of action for divorce against her husband, the defendant, on *506the ground of extreme cruelty, and also alleged that she was engaged with the defendant in a general mercantile business under a partnership arrangement whereby, as sole owners and partners, they conducted and operated a business under the firm name of Bishop’s Bakery in the city of Butte, the profits of which were to be equally divided and the losses equally borne; that the defendant had refused to keep books of account showing the profits or losses of said business,…
