ARROWOOD, Judge.

*529 The Charlotte-Mecklenburg Hospital Authority ("defendant"), d/b/a Carolinas Healthcare System and CMC-Northeast, appeals from judgment in favor of the Estate of Anthony Lawrence Savino ("plaintiff") and orders denying motions for a judgment notwithstanding the verdict ("JNOV") or for a new trial. For the following reasons, we reverse in part, vacate in part, and grant a new trial on non-economic damages.
