—Order, Surrogate’s Court, New York County (Eve Preminger, S.), entered on or about April 4, 1994, which granted respondents’ motion for summary judgment dismissing petitioners’ application to reopen a 1973 decree of the same court (Samuel DiFalco, S.) settling the final account of the deceased’s executors, unanimously affirmed, without costs.

The Surrogate properly refused to reopen the 1973 accounting, even if it be assumed in petitioners’ favor that the decedent intended that his two children involved in these proceedings share control of the family business, contrary to the ultimate result…
