This is a contested proceeding to settle the first intermediate account of Chase Manhattan Bank (now JP Morgan Chase [petitioner]) as cotrustee of a testamentary trust created under the will of Blanche D. Hunter (decedent) for the benefit of Pamela Townley Creighton (objectant), a granddaughter of decedent. Petitioner moves for an order pursuant to CPLR 3211 or, in the alternative, for summary judgment, dismissing certain objections to the account, on the basis that they are barred under the doctrine of res judicata.
