I have four motions before me, a Motion to Add a Cause of Action, a Motion to Strike Extraneous Material and Cross-Motions for Summary Judgment. 1 I will address each separately.
FACTS
Defendant Eli Harari (“Harari”.), served as President of Orit Menswear Company, Inc. (“Orit”), a subsidiary of the Gitano Group, Inc. (“Gitano”), and one of the Debtors, from approximately September 1989 to June 1993.
