MEMORANDUM OPINION AND ORDER
WINGATE, District Judge.
Before the court is the defendant’s Motion for Summary Judgment, filed pursuant to Rules 56(b)1 and (c)2 of the Federal Rules of Civil Procedure. The complaint in this action alleges that the plaintiff, Cleveland Ellison, was diseriminatorily discharged because of his African-American race by the defendant, GRMI, Inc., d/b/a Red Lobster Restaurants (“Red Lobster”), misnamed in the complaint as Darden Restaurants, Inc., d/b/a Red Lobster Restaurants.
