The parties in error will be referred to herein as plaintiff and defendant, as they appeared at the trial.

The plaintiff was beneficiary in a certificate of life insurance issued by the defendant association upon the life of one of its alleged members. The insured allegedly died as a result of an illness specifically excluded from the operation of the certificate by the terms of the written application therefor signed by the insured member.
