The petition for writ of certiorari was granted, and oral argument has been had following the filing of supplemental briefs.

On May 19, 1945, a Justice of the Peace of Benton County rendered a judgment for $159.80 against Joe Smith and wife in favor of Joe N. Frazier, a merchant in that county. On June 16,1945 Smith and wife filed their hill in chancery alleging • that said judgment was void for want of service of process and because no legal *73evidence of the alleged indebtedness was filed with the Magistrate.
