Tort, for the loss of the plaintiff’s property by fire caused by the alleged negligence of the defendant. Trial in the Superior Court, before Hopkins, J., who ruled that the plaintiff could not recover, and directed the jury to return a verdict for the defendant ; and the plaintiff alleged exceptions. The facts appear in the opinion. The case was argued at the bar in October, 1897, and after-wards was submitted on briefs to all the justices except Holmes, J.

This is an action of tort to recover for the loss of the plaintiff’s buildings and other property by fire, under the following circumstances. The defendant owned and operated a branch railroad extending from its main line at South Spencer to the village of Spencer, and had at the Spencer terminus a passenger station, a freight house, and a freight yard, all adjoining a public street. On the side of the freight house, and. extending beyond it about seventy-five feet, was a wooden platform about eight feet wide and four feet high, placed upon posts set in the ground, the under side being left…
