Appeal from a judgment of the County Court of Montgomery County (Catena, J.), rendered December 12, 2001, upon a verdict convicting defendant of the crime of forgery in the second degree.

In late 1997, defendant assisted Peter Morat in setting up a business known as Herkimer Precut, Inc. Defendant acted as a consultant for Herkimer Precut and he was eventually supposed to receive a 20% interest in the company once it met certain financial obligations.
