Plaintiff Midland Mortgage Company (“Plaintiff’) filed this action for damages, alleging state law claims for negligence and negligent misrepresentation against Defendant Wells Fargo Bank, N.A. (“Defendant”). (ECF No. 24, pp. 4-5.) This matter is before the court on Defendant’s motions to dismiss and for summary judgment on the claims asserted against it by Plaintiff. (See ECF Nos. 29, 51.)
