MEMORANDUM OPINION AND ORDER DENYING MOTION TO DISMISS

Plaintiff HIJ Industries, Inc. (“HIJ”) asserts claims against the Debtor/Defendant seeking to bar his discharge under 11 U.S.C. § 727(a)(2) and/or except HIJ’s claims from the Debtor’s discharge under 11 U.S.C. § 523(a)(6). Debtor moves to dismiss the Complaint under Federal Rule of Civil Procedure 12(e), applicable herein pursuant to Federal Rule of Bankruptcy Procedure 7012(b).1 [ECF No. 17.] For *762the reasons set forth below, the Motion will be denied.
