MEMORANDUM OPINION AND ORDER

Plaintiff Denise A. Banks brings this action against the Secretary of the United States Department of Agriculture (“USDA”) under Title VII of the Civil Rights Act of 1964 (“Title VII”), 42 U.S.C. § 2000e et seq., alleging that while employed at the USDA she was discriminatorily removed from the Senior Executive Service (“SES”) because of her race and sex.
